Subject: | Collateral abuse of process |
Dear Colleagues
Does anyone have an authority where the tort of collateral abuse of process was applied to a process initiated in a private disciplinary tribunal ie an internal
disciplinary process in a club or corporation? All the Australian cases seem to focus on abuses initiated in judicial proceedings. My facts are basically:
Company is a government sponsored and licensed provider of training in health specialities
Director X of said company uncovers administrative abuses by other directors
Director X reports the company to the authorities
Company initiates disciplinary moves to expel Director X while the investigation is ongoing
Any suggestions gratefully received
